Dear Ms. Fuhrmans:
I am the Chief Compliance Officer for Pathology Service Associates, LLC, a third-party medical billing and business support services company for a some 75 laboratories and pathology practices nationwide, and I read with great interest your article in WSJ yesterday regarding UnitedHealth's deal with LabCorp and the company's threat to fine physicians who refer out of network -- but there is another angle to this story that has received little or no attention that I thought might be of interest to you as well.
Although UnitedHealth did enter into a nationwide contract with LabCorp, United still has contracts with many other local/community laboratories and pathology practices across the nation (many of our clients currently hold such contracts with United to provide a variety of laboratory and pathology services). However, while United has instructed its physicians to avoid the possible fine by making use of the on-line directory, United is using the on-line directory to steer laboratory work only to LabCorp and has refused to include any other contracted laboratories and pathologists in its on-line network provider directory. And as if that isn't bad enough, United has even refused to provide any form of written confirmation to these other contacted labs that the labs can use to satisfy physicians who have been referring work to them for years that they are in fact participating providers in the United network. So all of these other labs and pathologists who have contracts with United have no way to prove it to a physician who asks why they aren't in the United on-line directory.
I have been working this issue for several weeks with the local (South Carolina) office, only to have them ultimately tell me that while they generally update the on-line directory locally, their hands were tied in this case as a result of a prohibition from the national office that does not allow them to add any other locally contracted laboratories or pathologists to the on-line directory. In the alternative, I have requested that United prepare a one or two sentence letter, on United letterhead, which simply acknowledges/confirms that these local laboratories and pathologists are in fact contacted United network providers - but I have been told that their legal department would not approve such a letter.
I am currently in contact with someone in the Maryland regional office as I continue to try to work this issue up through the chain of command at United, but I thought you might find this other side of the United deal with LabCorp interesting as well
